Texas Gov. Greg Abbott declared a statewide disaster Sept. 28 over diesel shortages and record prices. The 30-day declaration expands use of tax-exempt diesel, increases allowable truck weights and relaxes certain emissions requirements. Texas diesel prices approached $5.86 per gallon, reflecting tight supplies and rising fuel costs.

The move is effectively an attempt to find more usable diesel inside the existing fuel system. Texas normally keeps dyed diesel off public roads because it is untaxed and intended for off-road use. The emergency order temporarily removes that state restriction.
