NY State Detention Camps for Anything the Governor Declares is a Threat?

Please would you provide clarity on this Bill.

Is this a legitimate Bill passed in NY, are we looking at FEMA camps being used for New York Americans who refuse vaccines or is it going to be worse…it’s all American’s or green card holders?

ANSWER: New York State Assembly Bill A416 empowers the governor, apparently in his sole discretion, to establish detention camps should the governor declare a public health emergency. This bill does allow for the detaining of anyone who “pose[s] an imminent and significant threat to the public health” until he or she is no longer contagious. It is far worse than some have reported for it is any disease, not just COVID.

Assemblyperson N. Nick Perry (AD-58), recently proposed bill A416, currently in committee for presubmission to the Assembly for the 2021 session, which relates to the “removal of cases, contacts and carriers of communicable diseases who are potentially dangerous to the public health.”
This bill, as written, states, “(u)pon determining by clear and convincing evidence that the health of others is or may be endangered by a case, contact or carrier, or suspected case, contact or carrier of a contagious disease that, in the opinion of the governor… may pose an imminent and significant threat to the public health resulting in severe morbidity or high mortality, the governor or his or her delegee…may order the removal and/or detention of such a person or of a group of such persons by issuing a single order, identifying such persons either by name or by a reasonably specific description of the individuals or group being detained.”
This bill is so unconstitutional it is stunning. The Bill fails to specify any timeframe, location, or criteria for the termination of this detention. It simply delegates full discretion to the governor and given Cuomo’s handling of nursing homes, this is just not acceptable. This is the most outrageous privacy violation and it reflects the dangerous disconnection these career politicians have with the people or the restraints upon government imposed by the Constitution.
This bill allows the governor to create detention camps like the Nazis or what the Americans did to the Japanese. It provides authority to create a clear and direct path to unconstitutional and indefinite detainment which could last for life entirely at the governor’s sole discretion. Due Process of Law is torn to shreds because everything rests in the hands of the governor. That is plain and simply tyranny.
To the best of my knowledge, this bill has NOT passed, and after what Cuomo has done, I seriously doubt it will become law at this time. However, this is the third time this has been attempted. This simply shows the mentality of politicians in New York toward the people.
