A 9th Circuit panel ruled 2-1 on Friday that California does not have to pull ballots from about 20,000 people the Justice Department says may not be citizens. The majority said the list is unreliable and setting the ballots aside risks stopping eligible voters from counting. District Judge David Carter had already turned down the request on October 28. The same appeals court had rejected an earlier emergency ask on October 26 as too late. The Justice Department filed its suit on October 15. Midterms are next Tuesday. California says the list includes many citizens. The judges wrote there is a material risk of disenfranchisement.
