AG Ken Paxton has sued baby food companies Gerber and Nestlé for selling baby food containing dangerous levels of arsenic and lead.

Congressional reports and Alaska testing in 2021 flagged heavy metals in infant rice cereal. Beech-Nut recalled its product. Gerber did not. In August 2025 Paxton opened a probe of Gerber and Plum Organics. Plum reached an agreement in September 2026 to keep metal levels under FDA and EU limits. On October 9 Paxton filed a deceptive-trade-practices suit in Collin County against Gerber and Nestlé USA. He announced it October 14. The petition cites Gerber’s own 2017–2019 testing: 67 batches of rice flour with more than nine times the arsenic limit allowed in bottled water, carrots with up to 17 times the cadmium limit, and sweet potatoes with nearly 10 times the lead limit. It says the company tested ingredients more than finished food and rarely tested for mercury, yet kept marketing the products as safe and rigorously tested. Gerber says its products meet FDA limits.
